All purchases made in the virtual store bitti.es (Bitti Bebé S.L.) are subject to the purchase conditions set forth in this document.
The sales carried out are distance sales regulated by current Spanish legislation on the matter. Completing and sending the Purchase Order expresses full and unreserved adherence to each and every one of the General Conditions, as indicated in the "I accept the General Conditions" box in the customer registration section. p>
Bitti.es is a virtual store belonging to Bitti Bebé S.L. with address at Av. Josep Tarradellas 155 -08029 Barcelona.
Once the final purchase order has been sent through the electronic means offered by bitti.es, an order confirmation will be sent to the email address indicated by the client. The responsibility for the veracity and correctness of the data offered by the client will be solely and exclusively the same.
In the case of payment by credit card, the order will be prepared and shipped immediately. If it is made by bank transfer, confirmation of receipt of the amount in our bank account will be required within the established period.
From that moment and in accordance with the established delivery times (see delivery times) the order will be shipped and delivered. Bitti.es declines all responsibility in reference to fortuitous causes and force majeure that make delivery impossible, informing the client of what happened and offering alternative solutions.
The prices indicated in bitti.es always include 21% VAT and are expressed in euros.
Bitti.es makes 3 different forms or means of payment available to the customer to make purchases in our virtual store:
Credit card: The card payment service is provided directly by a secure server of Banco Sabadell Atlántico. Bitti.es declines all responsibility in relation to the confidentiality and security of the information and data provided by the client on the occasion of the payment of their electronic purchases by credit card, to the extent that the treatment of said information and data is not exclusively under the control of bitti.es
Transfer: The customer may pay for their purchases by means of a bank transfer to the Banco Sabadell Atlántico account that they will receive in the order confirmation that will be sent to their email address. In this case, you must notify the income by sending an alert to our email info@bitti.es a> or by sending the proof of payment to the fax number 934 197 426. Once the total amount is received, the order will be prepared and shipped.
Paypal: The client has the possibility of paying through the international platform Paypal for secure payments over the internet. This system allows you to make purchases without having to enter your bank card details on each e-commerce site where purchases are made.
Scalapay: Buying with Scalapay you will receive your order immediately and you will pay in the number of installments that you have established. You agree that the terms are assigned to Retail Installments SPV 1 Limited, the related parties and their assignees, and you authorize such assignment.
The current scope of sale of bitti.es is the Peninsula and the Balearic Islands. For the Peninsula and the Balearic Islands and for products in stock, the delivery time is 24/48 business hours. We understand business days for delivery from Monday to Friday noon. For this reason, the delivery times indicated in the product sheet are limited to these delivery periods by the transport companies.
For deliveries in a period shorter than that proposed by bitti.es, bitti should be contacted in order to confirm their possibility.
The delivery period in which bitti.es undertakes to deliver the product appears on the tab of each product, which can vary between 2-15 days depending on the type of product and can be up to a month if the product is personalized . It could be the case of receiving the product before what had been established. If, on the other hand, there were any unforeseen delays, bitti.es will contact the client to notify and inform about how to proceed (See the Delivery Times section of the General Conditions) and will offer an alternative product or refund the amount if it does not satisfy to the customer, exclusively for the reason of delay in delivery as agreed in the accepted order.
For orders to the Peninsula over €50, delivery is free. For orders under €50 the standard charge will be €6.90. For orders to the Balearic Islands over €100, shipping is free. For orders under €100, the standard charge to the Balearic Islands will be €9.
If for any reason you are not satisfied with your order, you have a period of 14 calendar days to return it, counting from the date of delivery of the order according to the delivery receipt. (According to Art.44 of Law 7/1996 of January 15 on Retail Trade Management modified by Law 47/2002 of December 19).
In the case of wanting to make a change, the client must manage it by telephone through the customer service number 934 197 319, in that The return will be processed and the process to follow will be confirmed.
For this, the product must be in perfect condition and in its original packaging (otherwise the product suffers a depreciation), as well as all the documentation of the product. Bitti will reimburse the consumer for the total amount of the purchase, that is, the price of the product. The return shipping costs will be borne by the customer, as specified below.
In accordance with the exceptions to the Right of Withdrawal regulated in RDL 1/2007, the return of those products belonging to the group of car seats (for safety reasons), mounted strollers or products configured to measure (personalized).
Only in the event that bitti.es was responsible for the change due to damage or error in the preparation of the order, bitti.es would be responsible for the collection and replacement costs. p>
Before proceeding with the refund of the consumer's amount, the courier company will collect the product and once it arrives at bitti it will verify that all the previously mentioned conditions have been met; Then bitti will make the refund using the same payment method with which the purchase was made within a maximum period of 7-14 days.
The collection costs from the courier company that will collect the product and return it to the bitti warehouse will be borne by the client unless it is an error or defect of bitti.
In the case of a defective product bitti.es will be responsible for the collection transport and the new delivery of the product in a space of 24 to 48 hours if it is available in stock. If bitti.es is not available, it undertakes to duly inform the client of the estimated replacement time. Only in the case of not being able to deliver the product in less than a week with respect to the previously agreed bitti.es undertakes to refund the amount.
In the event of a breakdown or need to repair any product purchased at bitti.es, the customer must contact bitti.es through the contact section of the website, at the email address info@bitti.es or by phone at 934 197 319. You will immediately be informed of the process to follow in each case according to the service conditions that bitti.es has with each provider depending on the item to be repaired.
In the case of a defective product, the seller must proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, procedures that will be free for the consumer and user. The seller is responsible for any lack of conformity that is manifested within two years from delivery. The consumer and user must inform the seller of the lack of conformity within a period of two years from when they became aware of it.
In addition to the reminder of the existence of the legal guarantee of conformity for the goods, the existence and conditions of after-sales services and commercial guarantees.
All products have a 2-year warranty. Any replacement using the guarantee must be previously reviewed by the supervisor corresponding to each supplier. In each case, it will be certified that the defect causing the breakdown or malfunction comes expressly from manufacturing defects or causes expressed in the guarantee of each product. It will be each supplier who will decide on the reason for the malfunction of each product, the misuse of the product being expressly excluded from the right of replacement. Finally, note that some products may have longer warranty periods offered by the supplier. Said guarantee period and characteristics will be duly indicated in the documentation that accompanies each product.
The general conditions set out here are governed by the law in force in Spain on the matter, which will apply subsidiaryly to anything not provided for in them. Basically by law 34/2002 of 11 July on information services and electronic commerce, Data Protection Act 15/1999 of 13 December and Sales to Distance Act).
These General Conditions are governed by Spanish law. The parties are subject, for their choice, to the resolution of disputes and with the renunciation of any other law, to the courts and courts of the user's home.
